Disclosure for ALL Members

1. CONSENT TO DIGITAL SIGNATURE AND ELECTRONIC DOCUMENTS. By signing, electronically or otherwise below, Member thereby consents to electronically signing any and all documents, forms and/or agreements related to the Canada Credit Fix Services and/or Member's association therewith. Member also acknowledges and agrees digitally signed documents, forms and/or agreements shall have the same binding legal effect as if the electronically signed document, form and/or agreement were physically hand-signed in ink by Member. Member also consents to receive Canada Credit Fix's program related documents, forms, and/or agreements in electronic or digital form. Member has the right to receive paper copies of any documents digitally signed by requesting for copies of the same from Canada Credit Fix in writing. Member may later withdraw consent to electronically contract and/or sign documents by providing Canada Credit Fix written notice thereof. Future Service and program modifications can be done using the authorize Digital Signature.

2. CONSENT TO PHONE CALL RECORDING. By signing below, Member consents to Canada Credit Fix monitoring and/or recording any phone call conversation between a Canada Credit Fix representative and Member for quality assurance or other business purposes.

3. MAIL AND WEBSITE NOTIFICATION. Member agrees to receive updates via email or via Canada Credit Fix website notification for material updates and/or modifications regarding this Agreement or the Services and program and agrees to proactively check emails from Canada Credit Fix and the Canada Credit Fix website to stay updated regarding the Services, program and Agreement’s terms and conditions. Member will be deemed to have received electronic messages if sent to the last known email address provided by Member to Canada Credit Fix. Continued use of the Canada Credit Fix Services, program and/or website constitutes Member's affirmation of any such modifications. Given the vast nature of email and/or website notifications, Member understands that on occasion clerical or technical errors may occur and as such agrees that if so, the notification will not be binding if Member gives notice of the clerical or technical error to Canada Credit Fix and Canada Credit Fix corrects such within a reasonable time.

4. PRIVACY NOTICE. Canada Credit Fix has a comprehensive privacy statement which describes its privacy policies and practices. Member hereby agrees to visit and electronically receive this privacy statement via Canada Credit Fix Canada Credit Fix's website address; (www.CanadaCreditFix.com). Further, Member acknowledges that it has already reviewed this notice at Canada Credit Fix website and also agrees to receive, electronically via Canada Credit Fix’s website, future annual privacy notices and/or amendments to the existing privacy statement.

5. MODIFICATION OF AGREEMENT. Canada Credit Fix reserves the right to modify this Agreement by providing 30 (thirty) days notice to Member for modifications to this Agreement, Services or program.

6. FORCE MAJURE. Canada Credit Fix shall not be liable for delay or default in the performance of its obligations under this Agreement if such delay or default is caused by conditions beyond its reasonable control, including but not limited to, fire, flood, accident, earthquakes, electrical outages, telecommunications line failures, network failures, acts of God, or labor disputes.

7. ENTIRE AGREEMENT. This Agreement constitutes the entire agreement between Canada Credit Fix and the Member, and this Agreement supersedes any and all prior agreements and representations. This Agreement may be executed in counterparts and, if so executed, shall constitute one Agreement binding on all Parties.

8. MISCELLANEOUS. Whenever used, the singular shall include the plural, the plural the singular, and the use of any gender shall be applicable to all genders. The Agreement and the documents prepared in relation hereto shall be construed without regard to any presumption or other rule requiring construction against the Party who drafted it.

9. NO EXPRESS OR IMPLIED WARRANTY. Unless given to Member in written form with the word, "GUARANTEE", bolded and immediately preceding it in all capital letters, no Canada Credit Fix affirmation of fact, warranty or other representation should be implied or relied upon however related to this Agreement, programs, Services or relationship with Canada Credit Fix.

10. DUTY TO ACT IN GOOD FAITH. The Parties agree no dispute shall be ripe for mediation, arbitration or court proceedings unless and until the Parties have, in good faith, made reasonable efforts to resolve any and all disputes informally. Member is under a duty to provide advance written notice to Canada Credit Fix of any such dispute. Member's notice is the triggering event for the Parties obligation to attempt an informal, good faith resolution of any such dispute. If such dispute cannot be worked out within a reasonable timeframe, then the next step would be mediation, arbitration, and then civil proceedings.

11. REMEDIES UNDER THIS AGREEMENT. The Parties agree that punitive and treble damages, even if same are provided for by statute, are absolutely prohibited remedies under this Agreement. Canada Credit Fix shall not be liable for any incidental, indirect, special or consequential damages for any claim arising out of or related to this Agreement or the services contemplated hereunder even if Canada Credit Fix has been advised of the possibility of such damages. Further, Canada Credit Fix's maximum liability for any claim arising out of or related to this Agreement or the services contemplated hereunder shall not exceed the lessor of the sum of the fees paid by Member to Canada Credit Fix or $2000C. Additionally, if the damages or alleged injury is related to something that is disclaimed or otherwise disclosed by Canada Credit Fix within this Agreement, through the service provided during the Program or notice otherwise given to Member, then Canada Credit Fix shall not be liable as Member entered into the Agreement and relationship voluntarily, knowingly and understanding of such risks, which were assumed by Member. Canada Credit Fix shall not be liable for any damage to Member property caused by any action or inaction on the part of any third party, whether negligent or intentional. Member's exclusive remedy to any alleged, claimed or proven liability, damage or reimbursement in which third party is one of or the sole wrongdoer shall be solely with such third party without any direct or indirect claim or rights to damages or other remedy against Canada Credit Fix.

12. LITIGATION COSTS. If any legal action or other proceeding is brought by Member or Canada Credit Fix for the enforcement or interpretation of this Agreement, each Party shall be responsible for its own incurred solicitors' fees and mediation, arbitration and litigation costs.

13. GOVERNING LAW AND VENUE. The interpretation or enforcement of this Agreement, including any claim arising out of or in any way related to the Parties’ relationship contemplated hereunder shall be construed in accordance with the laws of the Province of Alberta, without regard to conflict of law principles, with the courts of the Province of Alberta having exclusive and sole jurisdiction. The Parties agree that Calgary, Alberta is the exclusive venue for any matter under the Agreement. Notwithstanding this, if any part of this Agreement is in conflict with any law deemed to control it by a Court with competent jurisdiction, then such confliction part shall only be redacted to the extent necessary to leave this Agreement as complete as possible, as was originally intended and without being in continued conflict. Every term, provision, phrase, paragraph, condition, or otherwise contained within this Agreement shall be interpreted and upheld to the fullest extent permitted by applicable law. The Member deems and elects all transactions, services, business matters and under the Agreement as being executed in Alberta despite their own province of residency.

14. SHORTENED STATUTE OF LIMITATIONS. Any dispute in law or equity arising out of or related to this Agreement or the Parties relationship hereunder shall be brought within 1 (one) year from the happening of the alleged act or occurrence giving rise to the dispute or, in the alternative, when the complaining Party knew of reasonably should have known of said act or occurrence through due diligence or otherwise. No action may be brought after this period expires. By signing below, Member understands and agrees this shortened statute of limitations may be considerably less than that which might otherwise be applicable under the law.

15. NON WAIVER. Canada Credit Fix's failure or delay to exercise any of its rights under this Agreement, or its waiver of a right on any occasion shall not constitute a waiver of the same right or any other right on any other occasion.

16. INDEMNIFICATION. Member agrees to indemnify and hold Canada Credit Fix harmless from liability incurred, which is based, directly or indirectly, on false, inaccurate or misleading information provided by Member, or Member's failure to timely perform such conditions as stated within Agreement.

17. TRANSFERABILITY. Canada Credit Fix reserves the right to assign its rights under this Agreement, to delegate its duties under this Agreement, or to sell this Agreement in whole or in part.

The Applicant entering into this Agreement confirms that they have read and understand all of the contents, terms and conditions within this Agreement. Upon signature and any payment, the Applicant will hereby become a Premium Member. If you do not understand this agreement please seek legal advice and counsel or contact us for further information or clarification prior to signing.

This Agreement is hereby signed on [DATE] on an Electronic Data System located in Alberta, Canada. The Applicant herby engages the services of an Alberta Corporation and is aware that all services will be performed in Alberta despite the Member’s geographical location.

ANNEX: Addendum A. Disclosure: Services Form

1. Canada Credit Fix offers credit and debt services and related assistance through Affiliates and Partners. CCF is not providing debt consolidation, debt settlement, credit counseling; or insolvency, bankruptcy, financial or legal services. Canada Credit Fix is not a certified or licensed financial planner or public accountant and does not offer these financial services. Canada Credit Fix is not a legal firm, does not and has not offered legal advice and does not make legal representations in regards to any of its programs or Services.

2. Canada Credit Fix will not make monthly payments to creditors of the Member. No part of the fees under this Agreement will be applied toward any debt or loan.

3. Canada Credit Fix has not advised the Member to stop or reduce any payments to creditors. It is the decision of the Member to stop paying creditors because Member cannot afford to pay any or all minimum monthly payments. If circumstances of the Member change and they are again able to pay some or all creditors, Member may notify Canada Credit Fix.

4. Because Member may not be able to afford to pay creditors, Member understands that this can or may have a derogatory effect on credit and credit report or rating in the form of derogatory comments, late marks, charge-offs or decrease in credit score. Member also understand that Member may not be able to obtain new credit as a result of their credit rating and credit report.

5. Creditors still possess the right to pursue any legally entitled collection efforts, including reasonable collection communications efforts, arbitration or litigation. Member also understands that creditors and collection agencies may exercise their right to obtain judgments and garnishees.

6. Some banks or institutions have setoff rights. This means that if Member has a deposit account and a credit card with the same bank, the bank may try to take the money from my deposit account to satisfy credit card debt.

7. Canada Credit Fix cannot guarantee that any communications under this Agreement will produce any specific results. Canada Credit Fix can only offer projections primarily based on past experience, professional estimates, industry statistics and information supplied by Member. Canada Credit Fix does not make guarantees or provide any express or implied warranties about any elements of their Services or programs.

8. Canada Credit Fix does NOT guarantee that the Member will be able to prevent a foreclosure or avoid deficiency or other judgments. Member understands that the mortgage lender reserves the right to continue their foreclosure process and obtain judgments. There is no refund to any fees paid and Member understands the risks of repossession should the Member be unsuccessful with any proposals or mitigation efforts. Canada Credit Fix cannot and does not guarantee results or strategies.

9. Member agrees to pay additional fees from this account Add-On Service; fully understands that in no way is this or any money paid under the Agreement classified as an upfront fee for debt settlement. Member also understands that these fees are non-refundable.

10. No company, including Canada Credit Fix, can guarantee or stop creditor/collection calls.

11. Canada Credit Fix does not verify Member’s financial status. It is Member’s responsibility to be truthful with Canada Credit Fix. Canada Credit Fix may terminate this Agreement if it finds that Member has not been completely forthcoming or have provided false or misleading information.

12. Canada Credit Fix is not a pay processor, money transmitter, or agent of a bank.

By signing below, you hereby acknowledge that you have read, understand and agree to the entire document and all terms, conditions and statements inclusive of the master Agreement, and Annex : Addendums A. If not, please call us to review prior to signing. The Agreement and Annex: Addendum A are hereby deemed to be executed and fully binding upon my signature. The execution of this document will hereby be the "Effective Date".
